The judge who stood up to Donald Trump's 'refugee ban'

On Saturday, a NY federal court issued an emergency stay on US President Donald Trump's executive order banning immigration from seven predominantly Muslim countries.

Trump's executive order on immigration quickly reverberated across the United States and the world Saturday, slamming the border shut for an Iranian scientist headed to a lab in MA, a Syrian refugee family headed to a new life in OH and countless others. From 2009 to 2015, she served as a judge of the New York Court of Claims.

Ali Khoshbakhti Vayeghan, was put on a plane to Dubai before the judge issued the order.

While federal immigration officials routinely ask guest speakers at naturalization ceremonies to stay away from politics, federal judges are free to discuss anything they want. The groups also brought an emergency request "to prevent the imminent repatriation of dozens and dozens of refugees, visa-holders, and other individuals from nations subject to the January 27 executive order".

Within hours of the order, immigrants had been detained at airports around the United States.




The order seeks to priorities refugees fleeing religious persecution.

"We've gotten reports of people being detained all over the country", said Becca Heller, director of the International Refugee Assistance Project. "Instead, CBP is holding Petitioners at JFK Airport exclusively pursuant to an executive order issued on January 27, 2017", court papers said. So all of the thousands of people from countries like Syria who are still in the process of obtaining visas will still be barred form entering the United States.

Donnelly's order barred USA border agents from removing anyone who arrived in the us with a valid visa from Iraq, Syria, Iran, Sudan, Libya, Somalia and Yemen.

On Sunday, Donnelly's former boss, Robert Morgenthau, hailed her ruling that Trump's order would cause "irreparable injury" to some immigrants if they were forced to return to their home countries. However, she did give some optimism to civil rights advocates who are hoping a court will ultimately stop the enforcement of Trump's entire action. This order has a long road ahead in the federal court.
