The New Travel Ban Goes Into Effect Tonight

The New Travel Ban Goes Into Effect Tonight

US District Judge Theodore Chuang didn't rule from the bench after hearing the arguments in Maryland.

Chuang heard a complaint filed by a coalition of advocacy groups that included the American Civil Liberties Union, the most powerful USA human rights organisation. Indeed, Trump might even be looking to save face with this sheared down version of his previous executive order.

"In his mind, the danger of Muslims and the danger of refugees is all combined danger", Omar Jadwat, a lawyer for the ACLU, said of the president.

A hearing on President Donald Trump's revised travel ban is underway in federal court in Seattle.

"Our claim is the executive order in goal and effect is meant to discriminate against Muslims and it condemns their religion", Cox added.

Trump's first ban, signed January 27, went into effect immediately, triggering chaos at airports around the world, as travelers overseas were blocked from boarding US -bound flights and those in transit were detained at USA airports.

There's no denying, however, that the Trump administration will have a much stronger case defending the revised ban compared with the original one.

It said the federal government can't enforce the new travel ban unless it asks Judge Robart to modify his original restraining order.

Questioned about tweets that Trump sent and statements he made during the presidential campaign in which he promised to enact a "Muslim ban", Wall said: "there is a difference between a president and a candidate". "Unfortunately, it has replaced it with a scaled-back version that shares the same fatal flaws", said Omar Jadwat, director of the American Civil Liberties Union's Immigrant Rights Project.

In a separate case, the state of Hawaii has filed its own amended lawsuit challenging the ban. The judges there could also issue rulings the same day.

For some context, the first travel ban attempted to restrict travel from seven Muslim-majority nations while the current proposal aims to restrict travel from six: Iran, Libya, Somalia, Sudan, Yemen and Syria for 90 days.

The revamped travel ban explicitly exempts holders of valid visas or legal permanent residents, as well as citizens of Iraq.

A USA judge in Hawaii scheduled a hearing on a challenge to the ban brought by the state's attorney general and a Muslim imam who lives there.

Hawaii is one of several states where the travel ban is being challenged before its planned implementation Thursday.

Critics also argue that it will have a very negative effect on schools and universities and the business world, mainly the high tech sector, which employs many highly skilled immigrants. Yet, the new EO, issued on March 6, 2017, remains fundamentally flawed because it perpetuates the central constitutional infirmity: discrimination on the basis of religion in violation of the Establishment Clause.

Fourteen state attorneys general and 58 technology companies have filed amicus briefs supporting Hawaii's challenge.

Trump lashed out at Robart - calling him a "so-called judge" - and at the 9th Circuit, saying their decision was politically motivated.

The states argue that the new order harmed state colleges and universities; has disrupted staffing and research at state medical institutions; has reduced tax revenues and is broadly harming the states' economies.

But the new ban is just as damaging, according to the tech companies listed in the new court brief. The far flung Pacific state is home to many people of non-US origin.

State Attorney General Douglas Chin arrived at the Honolulu federal courtroom today after filing the challenge last week, claiming that the ban will harm Hawaii by highlighting the state's dependence on global travelers, its ethnic diversity and its welcoming reputation as the Aloha State.
